    The Data Privacy Analyst ("DPA") provides guidance and support for data privacy management & compliance activities in Cargill as a member of the Global Privacy Office.

    The primary goal of Cargill's Global Privacy Office is ensure sufficient organizational accountability within Cargill to its data privacy policies; and to ensure organizational compliance to global privacy laws, regulations and practices. As part of Cargill's Technology Governance Risk and Controls organization, the Global Privacy Office will achieve and sustain an acceptable level of risk in Cargill's business processes through the development and implementation of a data privacy program and its subsequent operations.


    The Global Privacy Office will build and maintain relationships with internal and external stakeholders, develop and provision education and awareness training, monitor ongoing legal and regulatory changes and provide guidance to Tartan teams, including Tartan Service Delivery, Functions and Platforms to design and build appropriate business processes, application security, and technical controls to enable Cargill to meet privacy requirements. 


    Principal Accountabilities:


    60% - Tartan, Functions and Platform Consultation

    • Advise TGRC Risk Managers and Analysts by assisting, advising, investigating, researching and resolving matters within the privacy policy to ensure that company personnel are aware of and in compliance with applicable laws and regulations.
    • Provide guidance to Tartan teams, including Tartan Service Delivery, Functions and Platforms to design and build appropriate business processes, application security, and technical controls.
    • Provide guidance for the localization of data privacy requirements and ensure existing policy is matched with appropriate processes and controls to ensure compliance.
    • Support Platform Technology Risk and Control Managers to resolve any data privacy related audit findings

    40% - Program Operations

    • Assist maintaining Cargill's data privacy principles, policies and procedures in coordination with TGRC, the Law Department and outside counsel, Global Security, Tartan, Human Resources, and other departments as required.
    • Assist with the development and provision of privacy training and education. Initiate, facilitate and promote activities to foster data privacy awareness within Cargill.
    • Conduct assessments of data privacy program compliance with all levels of management to proactively identify and rectify data privacy related control deficiencies.
    • Monitor ongoing compliance of data privacy program, prepare and present quarterly metrics to global TGRC leader and Executive Steering Committee.
    • Address any audit findings through appropriate resolution and report progress regularly to TGRC management.
    • Assist with government inquiries, compliance reviews or investigations related to data privacy or security, in collaboration with legal counsel
    • Assist with maintaining Cargill's relationship with regulatory authorities, external counsel, and other third parties as required.

Salary Range: $57,400 - $71,800 annually depending upon qualifications and experience

This position is eligible for a target bonus of 5%

 

  • Job Duties:

  • 1. Oversee and manage the centralized Contract Management process for all non I.S. contracts, to ensure adequate contract negotiation, implementation, maximization, and renewal.

    - Provide high level expertise in both compliance oversight and operational service to the organization to ensure the Company is protected through appropriate contract language.

    -  Expand the use of the Contract Management Database throughout the organization, providing training and education as appropriate.

             o Develop and support automated solutions where possible to assist business units 
                entering existing contracts in the database.

    - Provide associates access to information to enhance their ability to manage existing contracts, and leverage business relationships.

              o Monitor participation, identify and resolve issues that impede adoption of the centralized
                 management process and database.

              o Monitor associates' experiences and develop database enhancement to improve the
                 process and contract owners' ability to monitor their contracts.

    - Develop and maintain contract clause library working with associates in the business areas and Law Department to identify and maintain content for the library.

    - Monitor contracts based on defined risk-ranking standards.

    - Perform and manage ongoing testing of third party obligations.

    - Provide reporting to senior management including Corporate Compliance Officer and CFO and appropriate Steering Committees any material matters of non-compliance.

    2. Manage the Due Diligence Program to protect customer and company information, as well as monitor the third party's ability to protect and manage information stored external to our organization. 

    - Identify opportunities and provide education to associates of the requirements of the due diligence review process. 

    - Work with SBUs to identify vendors that have not submitted due diligence responses.

    - Monitor the regulatory environment and assure the process and procedures support compliance as new regulations are released. 

    - Work with business owners to obtain current due diligence information for the vendors ranked with a higher risk exposure.

    - Participate in the review of new technology solutions and identify compliance requirements and potential risks to customer and company information.

    - Build knowledge of technology developments as they apply to our business solutions.

    - Manage vendor repository to ensure appropriate information is logged and tracked on the Company's vendors to ensure proper actions are identified and executed.

    - Periodically conduct risk assessment and testing of current vendors, rank by risk exposure, and determine schedule and process for on-site due diligence visits.

    3. Manage the Third Party Response program including client and regulatory response to due diligence questions regarding the Company's information protection controls.

    - Manage central response to third party/client questionnaires on the Company's information protection controls.

    - Partner with Information Security, Privacy Officer, and other associates to ensure accurate and complete response to information protection control questions from third parties.

    - Develop standard response repository to third party questionnaires that are maintained up to date with current policies and practices.

    - Manage on-site visits by us or by third parties relative to information protection operations.

  •  Preferred skills for this job:  Knowledge of contract law, paralegal experience for reviewing contracts.
